TM-A application, Nice Classification, examination, opposition, and renewal procedures

1. Overview of Trademark Registration

Trademark registration in India is governed by the Trade Marks Act, 1999 and Trade Mark Rules, 2017. The registration process has been streamlined through the online e-Filing system managed by the Controller General of Patents, Designs and Trade Marks.

2. TM-A Application Form

Form TM-A is the primary application form for trademark registration. The 2017 Rules consolidated multiple forms into simplified formats.

3. Nice Classification for Technology

The Nice Classification, an international system, categorizes goods and services into 45 classes. Technology-related marks typically fall under specific classes:

Multi-Class Applications

Under the 2017 Rules, a single application can cover multiple classes. Fee is calculated per class. For tech companies, typical filing strategy covers Classes 9, 35, 38, 41, and 42 for comprehensive protection.

4. Trademark Registration Process

Trademark Search

Conduct search on IP India portal (ipindia.gov.in) to check for existing similar marks. Review phonetic, visual, and conceptual similarities.

Application Filing

File TM-A through online portal with mark representation, goods/services specification, and fee payment. Application number assigned immediately.

Vienna Codification

For device marks, Registry assigns Vienna Classification codes for figurative elements. This aids in searching for similar device marks.

Examination

Examiner reviews for absolute and relative grounds of refusal. Examination Report issued within 30-60 days typically.

Response to Examination Report

If objections raised, applicant must respond within 30 days (extendable by 30 days). May involve hearing before Registrar.

Publication

Accepted marks published in Trade Marks Journal for 4 months opposition period.

Opposition (if any)

Third parties may file opposition within 4 months. Opposition proceedings involve notice, counter-statement, evidence, and hearing.

Registration

If no opposition or opposition dismissed, registration certificate issued. Protection backdated to application date.

5. Examination - Grounds of Refusal

Absolute Grounds (Section 9)

  • Marks devoid of distinctive character
  • Marks that describe goods/services characteristics
  • Marks customary in current language or trade practices
  • Marks that may deceive public or cause confusion
  • Marks containing scandalous or offensive matter
  • Marks prohibited under Emblems and Names Act, 1950

Relative Grounds (Section 11)

  • Identity/similarity to earlier trademark for same/similar goods
  • Likelihood of confusion with earlier mark
  • Marks identical/similar to well-known trademarks
  • Earlier rights through use (passing off)
  • Prior copyright or design rights

6. Opposition Proceedings

Any person may file opposition within 4 months of publication. The opposition process involves several stages:

8. Renewal and Maintenance

Trademark registration is valid for 10 years from the application date and can be renewed indefinitely for successive 10-year periods.

Normal Renewal: Up to 6 months before expiry

Late Renewal: Within 6 months after expiry with surcharge

Restoration: Within 1 year of removal from register
